These Terms of Service ("Terms") govern your relationship with Quam Roofing and your use of our website and services. By accessing or using our website, you accept and agree to be bound by these Terms.

1. Services

Quam Roofing provides professional roofing services including but not limited to:

• Residential and commercial roof installation
• Roof repair and maintenance services
• Roof inspection and assessment
• Emergency roofing services
• Related consulting and advisory services

All services are provided subject to availability and our standard business practices.

2. Estimates and Quotes

All estimates and quotes provided by Quam Roofing are:

• Non-binding: All estimates are provided for informational purposes only
• Valid for 30 days: Quotes are subject to change after 30 days
• Based on information provided: Accuracy depends on the completeness and accuracy of information provided by the customer
• Subject to change: Final pricing may vary based on actual conditions discovered during work

3. Customer Responsibilities

Customers agree to:

• Provide accurate and complete information about their roofing needs
• Ensure safe access to the work area
• Remove or protect personal property in the work area
• Provide necessary permits or authorizations for work
• Make timely payments as agreed
• Follow all safety instructions and requirements

4. Payment Terms

Payment for services is due as follows:

• Deposit: 30% deposit required before work begins on projects over $2,000
• Milestone payments: Additional payments may be required at project milestones
• Final payment: Due upon completion and customer approval
• Payment methods: Cash, check, credit card, or electronic payment
• Late payments: Subject to 1.5% monthly interest charges

5. Cancellations and Changes

Cancellation and change policies:

• Free cancellation: Within 24 hours of booking for estimates under $500
• Cancellation fees: 25% of project cost for cancellations within 7 days of scheduled work
• No refunds: On deposits for work that has already begun
• Change requests: May result in additional charges or timeline changes
• Weather delays: Not subject to cancellation fees

6. Coverage and Commitments

We provide the following coverage:

• Workmanship coverage: 5 years on all labor performed
• Material coverage: As provided by the manufacturer
• Leak-free commitment: Customer satisfaction commitment on roof installations

Warranties are subject to proper maintenance and do not cover damage caused by:

• Acts of God or natural disasters
• Improper maintenance or modifications
• Third-party damage
• Normal wear and tear

7. Limitation of Liability

Quam Roofing's liability is limited as follows:

• We are not liable for indirect, incidental, or consequential damages
• Total liability shall not exceed the amount paid for the services
• We are not responsible for pre-existing conditions not disclosed
• We are not liable for delays caused by weather, permitting, or other factors beyond our control

8. Insurance and Permits

Insurance and permitting responsibilities:

• We maintain general liability and workers' compensation insurance
• Proof of insurance available upon request
• Customer is responsible for obtaining necessary permits unless otherwise agreed
• We will assist with permit applications when requested

9. Safety and Access

Safety requirements:

• We follow all OSHA safety regulations and industry best practices
• Customers must ensure safe access to work areas
• Pets and children must be kept away from work areas
• We are not responsible for accidents caused by unsafe conditions

10. Intellectual Property

All content on our website, including text, images, logos, and designs, is our property or the property of our licensors and is protected by intellectual property laws.

11. Dispute Resolution

Disputes shall be resolved as follows:

• Negotiation: Parties will attempt to resolve disputes through good faith negotiation
• Mediation: If negotiation fails, parties agree to mediate with a neutral third party
• Arbitration: If mediation fails, disputes will be resolved through binding arbitration
• Venue: Any legal action shall be brought in courts located in South Dakota

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law principles.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

14. Entire Agreement

These Terms constitute the entire agreement between you and Quam Roofing regarding the subject matter hereof and supersede all prior agreements and understandings, whether written or oral.
